What's the difference between ...



a closing agent,





... a notary,







...a signing agent?

Although these terms are often used interchangeably, they are not the same. The following covers the broad distinctions:

A Closing Agent is the person, usually from a title or escrow company, who is coordinating the assembly of the documents, disbursement of funds, and other duties associated with CLOSING a loan. Although the closing agent may also be a notary, he or she will often locate a suitable signing agent, ofthen through a third-party service. And...even though that time when everyone is sitting down to sign papers is often referred to as a "closing," this signing is really only a PORTION of the closing process.

A Notary Public has been commissioned by their state to be an impartial witness to certain kinds of transactions. Full Notarial authority will vary from state to state. Although notarization is an essential element to real estate transactions, merely being commissioned does not automatically qualify a person to recognize and identify various elements of loan documents. Eaglecliff notaries are experienced in various aspects of the mortgage and real esate industries, which contributes substantially to efficient signings.

A Signing Agent is a duly commissioned notary public who has become skilled, through experience and/or education in facilitating the signing portion of the mortgage loan closing process. Eaglecliff notaries hold various certifications, and are constantly expanding their education and expertise.

We practice discretion when discussing the documents and terms of the loan. Aside from "textbook type" answers, we defer to the lender. If this is something that obviously can wait (especially in the case of an after-hours signing), suggest the borrowers call the recommended contact the next day for explanation. We understand that, such issues can be resolved with an explanation by the lender.

While the borrowers must be made clearly aware of their right of rescission, we do not emphasize this as a way to push borrowers to sign documents with which they are clearly uncomfortable.
